Terms and Conditions of Use

Purpose of the Contract

The Platform allows the Agency to access tourism services, including booking hotel rooms, transfers, and experiences (hereinafter, "the Services"). These Services are offered by us, as consolidators, and are subject to the availability and specific conditions of each provider.

Registration and Use of the Platform

The Agency must provide truthful and complete information during the registration process, including its trade name, address, phone number, and any other information requested. The Agency is responsible for maintaining the confidentiality of its account and all activities that occur under its account. Any unauthorized use must be reported immediately. The use of the Platform is limited to making reservations and managing Services for its clients. Any other use, including the unauthorized resale of Services, is prohibited.

Limit on Registered Agents

The Agency may register up to 50 agents to use the Platform. If the Agency wishes to register more than 50 agents, prior written authorization must be requested, which will be subject to our approval and possible additional costs.

Commissions and Payments

The Agency will receive a commission for each confirmed booking made through the Platform. Commissions will be calculated based on the previously established percentages. The payment of commissions will be made within the agreed timeframes and in accordance with the payment methods established by us. We reserve the right to modify commission rates at any time, with prior notice to the Agency. We reserve the right to apply a Service Fee, which may vary depending on whether the reservation is made directly by the Agency or through our agency support team.

Service Fees

An annual service fee of $600 USD is established for the use of the Platform. The specific terms and conditions regarding billing and payment of this fee will be provided at a later date.

Agency Responsibilities

The Agency is responsible for the accuracy and truthfulness of all information provided on the Platform. The Agency will be solely responsible for the relationship with its clients, including the communication of booking terms, cancellations, and any other conditions related to the Services.

The Agency agrees to indemnify and hold us harmless from any claim, demand, or legal action arising from the misuse of the Platform or failure to comply with these terms.

Cancellation and Modification Policy

Cancellation and modification policies will be subject to the specific conditions of each Service booked. The Agency must promptly communicate any cancellation or modification to its clients and ensure that applicable policies are followed. Any costs associated with cancellations or modifications will be the responsibility of the Agency or the client, as applicable.

Confidentiality and Data Protection

The Agency agrees to maintain the confidentiality of all commercial and technical information accessed through the Platform. Personal information and data collected through the Platform will be handled in accordance with our privacy policy and applicable laws.

Modifications to the Terms and Conditions

We reserve the right to modify these terms and conditions at any time. Any changes will be communicated to the Agency through the Platform or other communication channels. Continued use of the Platform after such notification will constitute acceptance of the modifications.

Duration and Termination

This agreement will take effect once the Agency's registration is completed and will continue until either party decides to terminate it. We reserve the right to suspend or terminate the Agency's access to the Platform in the event of a breach of these terms or any conduct that we deem harmful to our operations or reputation.

Governing Law and Jurisdiction

These terms and conditions are governed by the laws of Mexico, and any dispute will be resolved in the competent courts of Quintana Roo.

Privacy Policy

TAMARAN S.A. DE C.V. (MAR HOLIDAYS), with address at ACCESO XCALACOCO, NUMBER 1, C.P. 77710, PLAYA DEL CARMEN, QUINTANA ROO, MÉXICO, and the website https://www.marholidaystravelnetwork.com, is the responsible of the use and protection of your personal information, and inform you of the following:

1. WHICH DATA DO WE COLLECT?

We collect your Personal Data through the Services, when you provide it to us personally, by telephone and through any other source provided for and permitted by Law. By way of example, but not limited to, the Personal Data we obtain are: name and surname, personal address, personal telephone number, personal email, copy of your official identification, number of the aforementioned official identification, Unique Code of the Population Registry, nationality, Federal Taxpayer Registry, account number, credit or debit card number.

We do not collect data that reveals aspects that may give rise to discrimination, such as race or ethnicity, health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, or sexual preference (the “Sensitive Personal Data”).

Some Personal Data is collected automatically when you use or browse the Services, while others are collected through data that you provide to us directly.

Therefore, the Controller collects the following types of Personal Data through the Services:

• Information collected automatically. When you download or use an application or browse a website, we collect information about your device and the network you use to access the Services, as well as information about your use of the Services. This includes software and hardware attributes of the device used, unique device information (such as unique international mobile equipment (IME) identity number for smartphones), regional and language settings, network provider and IP address, as well as data from service performance, dates and times you use the Services, the amount of time spent on specific pages or in specific channels and other similar usage information.
• Location information. We may also collect location information, depending on the Services you use or the permissions provided. Precise location information may be derived from your device's GPS and location systems, as well as nearby Wi-Fi networks and cell towers. Imprecise location information may include your IP address or other data that can be identified as being located within a specific region, city or zip code. You can manage the ability of services to track your location by allowing or disallowing you to accept access for a particular service in your computer or mobile device settings.
• Other information that you provide to us. We collect Personal Data when you provide it to us for specific purposes, such as providing you with information or services that you request, including reservations to carry out a transaction or reservation, to respond to an inquiry; when you submit content to social networks or interact with a social media channel; when you respond to a customer survey or apply for a position with us. Depending on the services used, or the products, or the information requested, your information collected may include your name, telephone number, email address, account information, address, billing information, region, travel plans, trips status, order or service history, hotel guest stay preferences, use of hotel services, information you provide about children accompanying you, social media account information (such as account or handle, number of followers, social media profile), loyalty or rewards program numbers, or (if you are applying for a position with us) employment-related information, as well as any additional information you may wish to enter in text fields, “ Contact Us,” email subscriptions, request for proposal forms, or that you provide to our customer service representatives.
• Information from third parties. We also collect or receive personal data from third parties. For example, if you reserve a room through a Channel Manager, Travel Agency, Reservation Service, or Event or Conference Promoter, we collect certain information from that third party as necessary to make and authenticate the reservation. If you interact with a social media channel or submit social media content to us, we receive certain data from the applicable social media platform. Depending on the type of information and the context in which it is used, the above information may be associated with data that we collect directly, that you have obtained from other sources, or that we have previously retained within a given user account.

Situations where your data may be required on this site:

• When you ask us something via chat, we will ask you for your email and your name.
• When you want to subscribe to receive promotions, we will ask you for your first name, last name, email address and country of origin.
• When you make a quote to purchase any of our products, services or activities from us, we will ask for your email address.
• When you make a purchase and have an account with us, we will request your email and password.
• When you make a purchase and do not have an account with us, we will request your name, surname, email, telephone number, state, country of origin and hotel where you are staying, we will also request your bank information and address to be able to make the purchase. If you want to have an account, all you need to do is add a password.
• When you request reports for Groups and Conventions, we will ask you for your name, surname, telephone number, email address and country of origin.
• When you request information for your wedding, we will request your name, last name, telephone number, email, country of origin, state and city.
• When you have any questions or suggestions through our Contact Us, we will ask for your name, telephone number and email.
• When you share your opinion about the experience, we will request your name and email.
• When you request Billing for your visits, we will request RFC, tax address and email.
• We never ask for sensitive personal data on any of our sites.
• We will also never ask for your username and password by phone or email.
• We never request credit or debit card information unless you are making a purchase.

2. PURPOSES OF DATA PROCESSING

When you connect to this site, to consult by chat, subscribe, quote, buy or request information, you are providing us with personal information and you are giving your consent for your information to be collected, used, managed and stored by us, only as described in this notice.

The purposes depend on where you have entered your personal data and are the following:

• Provide you with information that you have requested from us.
• Send you promotional communications related to any product or service available on our sites.

3. RIGHTS OVER PERSONAL DATA (RIGHTS OF THE OWNERS)

Users of the Services, including you, have a variety of legal rights regarding the processing of Personal Data. These rights may vary depending on the applicable legislation, but may include, but are not limited to:

• The right to know with whom we share your Personal Data.
• The right to receive a copy of your Personal Data.
• The right of access, rectification or cancellation of your Personal Data.

You may exercise any rights under your applicable law with respect to your Personal Data by contacting us as described in this Notice. We may request additional information to verify such requests. Additionally, you may be able to view, access, correct or delete some or all Personal Data through our consent and profile update protocol and procedures.

3.1 THE “ARCO” RIGHTS

You have the right to request access, rectification, cancellation and opposition to the processing of your Personal Data (the “ARCO Rights”). In addition, you have the right to request the revocation of the consent granted and the limitation of the use of Personal Data.

You can exercise your rights through the following means:

The request must contain and accompany the following:

- Name and address or other means to communicate the response to your request.

- Documents that prove your identity or, where applicable, legal representation.

- The clear and precise description of the personal data with respect to which you seek to exercise any of the rights related to the processing of your data; and any other element or document that facilitates the location of personal data.

In the event that the information provided in your request is erroneous or insufficient, or the necessary documents to prove your identity or the corresponding legal representation are not accompanied, the Controller will require the correction of the deficiencies in order to process it.

You may withdraw your consent for the processing of your personal data, without retroactive effect, in all those cases in which such revocation does not imply the impossibility of complying with obligations derived from a current legal relationship between the User and the Controller; You may also limit the processing of your personal data in cases expressly provided for by law.

The User will be responsible for keeping their personal data in the possession of the Controller updated. Therefore, the User guarantees and is responsible, in any case, for the veracity, accuracy, validity and authenticity of the Personal Data provided, and undertakes to keep it duly updated, communicating any changes to the Controller.

For security and in accordance with the Law, it is mandatory that every request be accompanied by information that allows us to ascertain the identity of the applicant, and, where applicable, their legal representative. Consequently, the request must be accompanied by the following documentation:

1. Signed application;

2. Copy of the owner's identification;

3. If acting through a legal representative, a simple copy of the public deed stating the power of the legal representative and a simple copy of his or her identification.

4. Address, telephone, and email;

5. Acceptance or refusal to be notified via email;

6. Clear and precise description of the Personal Data with respect to which you wish to exercise your ARCO Rights;

7. If applicable, specifically indicate what information must be corrected and how it must be read correctly;

8. If applicable, express statement to revoke consent to the handling of your Personal Data;

9. Any other information that allows us to identify your Personal Data.

We inform you that we maintain a record of all requests submitted. Likewise, in the event that the application submitted is incomplete, we have the right to request the missing information.

The applicant guarantees that the Personal Data provided is accurate, complete and real. Consequently, the applicant is responsible for any damage caused by falsehood or impersonation.

We will process your requests in the manner and times established in the Law and its Regulations. We undertake to respond no later than 20 (twenty) business days from receipt of the Request. Said Period may be extended for up to another 20 (twenty) business days as long as it is for justified cause and the owner is notified.

If you request access to your Personal Data, it will be provided to you electronically. If you expressly request it, the information will be sent to your address in a copy.

4. MECHANISMS FOR THE LIMITATION OF THE USE AND DISCLOSURE OF DATA

You can limit the use or disclosure of your personal data in order not to receive promotional information about our services.

5. TRANSFER OF YOUR PERSONAL DATA

We do not carry out transfers of Personal Data, except those provided for in article 37 of the Federal Law on Protection of Personal Data Held by Private Parties.

6. SECURITY MEASURES TO PROTECT YOUR PERSONAL INFORMATION

Your personal information will be protected under strict confidentiality and to reasonably prevent its improper use or disclosure, we have implemented physical, technical and administrative security measures, in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, regulations, guidelines and other applicable regulations.

Our policy is aligned with those requested in the applicable and current legal provisions.

7. OTHERS

7.1 PROTECTION OF THE PRIVACY OF MINORS

Aware of the importance of protecting the privacy of minors, this website is not designed for or intentionally directed to anyone under 18 years of age.

If you believe that we have information about a minor, please send an email to ventaspersonales@marholidaystravelnetwork.com, so that the information can be deleted from our systems.

7.2 USE OF IMAGES AND SOUND COLLECTED THROUGH OUR INTERNAL VIDEO SURVEILLANCE SYSTEMS

We inform you that we have internal video recording systems and circuits, which can capture images and in some cases sounds considered personal data, which will be treated and protected in the established terms.

8. CHANGES TO THE PRIVACY NOTICE

We recommend periodically visiting our PRIVACY NOTICE, as we make updates and modifications to adapt it to the laws that apply regarding the protection of personal data, use and management of cookies and internal policies.
